When no power of sale clause is available judicial foreclosure begins by lender filing law suit to order foreclosure. Sale follows court order and is to the highest bidder. Non judicial foreclosure will be under power of sale clause. There is power of sale guidelines to follow incase the included clause is unclear on procedures. Lender must, prior to proceeding, demand borrower through mail to clear dues in 20 days. If this expired and before 21 days of sale, lender records notice with the county clerk, mails it to lender at his last known address and posts it on the door of courthouse of county. Sale will be on first Tuesday of any month not withstanding a holiday, on the court doorsteps to the highest bidder. Lender is allowed to bid after retiring full or part of the balance due. Texas Foreclosure Law allows both judicial and non judicial procedures. No right of redemption whereas deficiency judgment is allowed. Time line is 60 days and security instruments are mortgage and deed of trust.
