Lender obtains a decree of sale from court by filing a complaint. If court sees default borrower is given time to pay due amount including costs. Failing which triggers order of sale by the court. Non judicial process follows power of sale clause or the guidelines for power of sale. Notice of sale is published for three different times with first one 20 days before the sale or posted at 5 places including court house and on the property it self at least 30 days in advance. A copy must be served to the borrower 20 days ahead. Highest bidder will win the auction but Sheriff can set a minimum acceptable value which must not be less than half of market value of the property. Winner gets certificate of sale on the instant and deed after expiration of right of redemption of the borrower which is two years.
