Both forms of foreclosure methods are available under Oklahoma Law. Deficiency judgment varies but right of redemption does not exist. There is a timeline of 90 days and security instruments are deed of trust and mortgage. Judicial Foreclosure: Court orders foreclosure of property following law suit filed by lender to highest bidder. Borrower has right to demand an appraisal of the property. Sale must not be allowed at n\values below 2/3rd of appraised value. No deficiency judgment after 90 days and neither is right of redemption after confirmation of sale by court. Non judicial foreclosure is by power of sale clause in the security instrument. If procedures to sale are not clear in the power of sale clause power of sale guidelines has to be followed. Under this a notice of lender’s intent to foreclose must reach borrower and give him 35 days to remedy it. If borrower had defaulted three times lender need not notify him any more. If the number of default were four in preceding 24 months a notice is necessary.
