Missouri Foreclosure
Missouri Foreclosure Law permits judicial Foreclosure and non judicial foreclosure. Deed of trust and mortgage are the security documents. Timeline is typically sixty days. Right of redemptions is allowed to the borrowers whereas lenders can’t avail deficiency judgments. Judicial foreclosure is simple and filing a law suit permits the foreclosure sale when it can not go to non judicial process. If one of the security documents has power of sale clause contained in them foreclosure procedure will be non judicial one. If ‘power of sale’ clause doesn’t detail out procedures of sale Power of Sale Foreclosure Guidelines must be followed. It requires that notice of sale be mailed to the home owner with a minimum of 20 days still to go for the sale. The notice must be run in the news papers. Sale is against cash and lender can also bid for it. Borrower must redeem his home within 12 months if lender wins the bid.
