Massachusetts Foreclosure
Both judicial and non judicial foreclosures are available. There is no right of redemption and deficiency judgment. Deed of trust and mortgages are the security documents. Typical timeline is 90 days. Foreclosure by possession: Borrower’s default leads to taking over possession by the lender by either of court order or peaceful entry in to the property or by consent of the buyer. Borrower looses right of redemption if lender maintains possession for three years. Non judicial foreclosure regulations are outlined in the guidelines. Record the notice of sale at the county court and to the borrower by registered mail14 days prior to sale. Publish in a local news paper for 3 weeks with first appearing 21 days in advance of sale. Notice to contain date, time and place of sale and name/address of the borrower and date of recording of the mortgage. Property has to be sold to the best bidder.
