Idaho Foreclosure
In Idaho Foreclosure Law only non judicial foreclosure is available. When the power of sale clause is not available in the deed of trust (primary instrument of security) or in the mortgage, foreclosure proceedings will follow Power of Sale Foreclosure Guidelines. Borrower and/or occupant of the property gets 120 days of notice after record. News paper advertisement must be for four weeks and not less than 30 days ahead of the sale. Notice to describe the property, nature of default, address and phone number of the borrower along with date, time and place of sale. Lender enjoys the right to postpone the sale but the next date, time and lace must be within the next thirty days. Right of Redemption for properties more than 20 acres is for one year and smaller ones will have the period reduced to six months. Typical timeline is 150 days and deficiency judgment is available to the lender.
