Delaware Foreclosure
Delaware Foreclosure Law allow lenders to seek only judicial foreclosure. Non judicial foreclosure and deficiency judgment are not available to the lender. Borrower can not avail the Right of Redemption once the court declares the sale.. Primary security instrument is just the mortgage and time frame is 90 days. A procedure called as ‘Scire Facias’ is followed popularly under judicial foreclosure law. It requires the borrower to prove he has not defaulted on his mortgage payments on the contrary to other states requiring the lender to prove the default. Borrower must prove in the court of law, within 20 days why he should not be sued for foreclosure. Sale is conducted in 14 days of notice. The notice is required to be posted on the property and prominent places in the county.
